Liability Waiver, Indemnity, and Assumption of Risk Agreement
By participating in any clinic, program, or activity at RippnerTennis LLC (RippnerTennis), I acknowledge and agree to the following:
- Assumption of Risk: I understand that tennis and related activities involve physical exertion of varying intensity and, thus, carry inherent risks, including, but not limited to: personal injury, property damage, or even death, resulting from activities while playing tennis. Risks include, but are not limited to: falls from tripping on tennis balls, being struck by tennis balls or equipment, and other accidents that may occur during activities or in and about the facility.
- Release of Liability: I hereby release, discharge, and hold harmless RippnerTennis, its members, managers, officers, employees, staff, instructors, agents, and any affiliates from any and all claims, demands, or causes of action, whether known or unknown, arising from my participation in any activities or my presence at any RippnerTennis facilities, including any and all claims for injury, loss, or damage to personal property, regardless of whether such injury or damage is caused by the negligence of RippnerTennis, its members, managers, officers, employees, staff instructors, agents, or its affiliates.
- Personal Belongings: I agree that RippnerTennis is not responsible for the safekeeping of my personal belongings, including but not limited to clothing, bags, or equipment, while I am attending any clinic, class, or program. Accordingly, I hereby release RippnerTennis and its members, managers, officers, employees, staff, instructors, agents, and any affiliates from any and all liability related to the same.
- Medical Conditions: I confirm that I am in good health and able to participate in tennis activities. I acknowledge, accept, and agree that my decision to participate in any RippnerTennis activities is my own, and I accept full and complete responsibility for my participation in any such activities. If I have any medical conditions or concerns that may affect my participation, I agree to disclose them to the staff prior to my participation and will provide written permission from a licensed healthcare provider if required.
- Property Damage: I understand that I may be at risk of accidental property loss or damage while on any RippnerTennis premises and agree that RippnerTennis is not liable for any such loss or damage.
- Indemnification: I hereby agree to indemnify and hold harmless RippnerTennis, its members, managers, officers, employees, staff, instructors, agents, and affiliates from any and all damages that may arise or be associated with my participation in any RippnerTennis activities or my presence on or at RippnerTennis facilities.
By checking the box below, I acknowledge that I have read, understood, and voluntarily accept the terms of this Liability Waiver, Indemnity, and Assumption of Risk Agreement.
